ATS Building Products Competition Terms and Conditions /

1 Promoter

The ATS Building Products ‘Win an Outdoor Catered Box’ competition, will be conducted for the benefit of ATS Building Products, 157 Briens Road, NORTHMEAD, NSW, 2152 Kellyville, NSW, 2155 by the Promoter, Parramatta National Rugby League Club Pty Limited, 304 Stone Mason Dr, whose authority to fundraise can be verified with the beneficiary.

3 Relevant State(s) 

Entry is open to residents of New South Wales aged 18 years or older. 

4 Promotion Period 

The raffle will commence on 12/5/2025 and close at 5:00 PM on 16/6/2025. 

7 Entry Restrictions

Entry is open to residents of the Relevant State(s) aged 18 years or older at the commencement of the competition. Entries made by any individual involved in the organisation of the competition will not be counted. In addition, entries cannot be made by Parramatta Eels board members or management, or by employees of ATS Building Products, or their respective immediate* family members. Entry is not permitted to anyone involved in the organisation of the competition including family members. If family members are drawn their entries will be forfeited.

* Immediate family means a person’s spouse, siblings, and family members residing at the same premises as the person. 

8 Verification Requirements 

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

Incomplete or indecipherable entries will be deemed invalid. 

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

Entries will be deemed to be accepted at the time of receipt by the Promoter and not at transmission by the entrant. 

The Promoter’s decision is final and no correspondence will be entered into. 

9 Draw Details 

To enter the draw, individuals must enter the relevant information during the Promotional Period from the website https://fans.parraeels.com.au/tb_app/524889 . The competition will be drawn at 11.00 AM on 16/8/2025 at ATS Head Office at 157 Briens Road, NORTHMEAD, NSW, 2152. One (1) entrant will be drawn and will be deemed the one (1) winner for the prize (‘Winners’). The draw will take place in accordance with State Government regulations. The draw will be conducted by the Promoter. Draw method: An electronic draw will be conducted. 

10 Prize Details

The first prize is an Outdoor Catered Box for eight (8) people at Commbank Stadium to watch Eels vs Titans on 22nd June 2025.

Any additional expenses incurred by winner in collecting and using the prize are at the Prize Winner’s cost. Where permissible by law, ATS Building Products exclude all liability for any loss, injury or expense that may arise by the winner's use of the prize. The Prize is not transferable or redeemable for cash. Prize values are accurate as at the commencement date for the competition. Some images are display only and may not be a true reflection of the prize. 
Total prize pool value is up to $1,960 incl. GST

Prizes are not transferable or exchangeable and cannot be taken as cash or re-sold, unless otherwise specified.  

11 Notification and Publication of Winners

Details of the minor Winner(s) will be displayed at https://fans.parraeels.com.au/tb_app/524889 after the draw on the 16/6/25. Winners will be contacted by phone and/or email. 

12 Prize Claim Date and Unclaimed Prize Arrangements

ATS Building Products reserves the right to re-draw the winners on 16/6/25  if no successful contact has been made on initial draw. If you are a Winner, you are responsible for your use of the prize, including complying with all relevant laws and any applicable terms and conditions of use. If the prize is not claimed by the Prize Claim Date or is deemed invalid in accordance with the Entry Restrictions, the Promoter reserves the right (subject to regulatory approval, if required) to sell that prize. Proceeds from such sale will be paid to the Promoter to be used for not-for-profit purposes

13 Privacy

The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy.   In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia. 

14 General

Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, pandemic unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. 

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner; or (f) use of a prize.
